Welcome to Pixel Terrace. These Terms of Service ("Terms") govern your use of our website and your purchase of any products from us. By visiting our site or placing an order, you agree to these Terms. If you don't agree, please don't use the site.

1. WHO WE ARE

This site is operated by Pixel Terrace ("Pixel Terrace," "we," "us," or "our"). Throughout the site, "you" refers to you as a visitor or customer.

2. WHO CAN USE THIS SITE

You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering, you confirm you meet that requirement and that the information you give us is accurate and complete.

You may not use our products or site for any unlawful purpose, to violate any law or regulation, to infringe anyone's intellectual property, to harass or abuse anyone, to submit false information, to upload viruses or malicious code, to collect or track other people's personal information, to spam, phish or scrape, or to interfere with the security of the site. We may terminate your access for violating any of this.

3. PRODUCTS, DESCRIPTIONS AND PRICING

We do our best to display our products and their colors accurately, but we can't guarantee that your screen shows colors exactly as they appear in person. Our smart pixel LED curtains are designed to be viewed at night, like any string lights; individual bulbs are visible up close, and designs read best from a distance.

Product descriptions, specifications, images and pricing may change at any time without notice. We may limit quantities, restrict sales by region, or discontinue a product at any time.

We try to keep pricing and product information accurate, but errors happen. If a product is listed at an incorrect price or with incorrect information, we reserve the right to cancel or refuse that order, even if it was already placed and confirmed. If we cancel and you've already been charged, we'll refund you in full.

All prices are in U.S. dollars.

4. ORDERS AND PAYMENT

Your order is an offer to buy. We may accept or decline any order, in whole or in part, at our discretion — including orders that appear fraudulent, are placed by resellers or dealers, or exceed normal household quantities. If we decline your order after charging you, we'll refund you in full.

You agree to provide current, complete and accurate purchase and account information for every purchase, and to promptly update your payment and contact details so we can complete your order.

By submitting payment information, you represent that you're authorized to use the payment method provided.

5. SHIPPING AND DELIVERY

We ship orders within 2 BUSINESS DAYS, and delivery typically takes 7–14 BUSINESS DAYS. 

These are estimates, not guarantees. Carrier delays, weather, customs and peak holiday volume can affect delivery. If we can't ship within our stated timeframe, we'll email you, and you can wait for the new date or cancel for a full refund.

Risk of loss passes to you once the carrier takes possession of your package. If your package arrives damaged, see our Return & Refund Policy — we'll make it right.

If you're ordering for a specific date, please order early. We can't guarantee delivery by any particular holiday.

6. RETURNS AND REFUNDS

Our Return & Refund Policy is part of these Terms. In short: you have 7 days from delivery to request a return for any reason, and 30 days from delivery for items that arrive damaged, defective, or incorrect. Please read the full policy for details.

7. PRODUCT SAFETY AND PROPER USE

Our products are electrical products. You agree to read and follow all included instructions and safety warnings, use only the power adapter supplied with the product, and keep the product and its connections away from water unless the product is rated for the conditions you're using it in.

Do not modify, cut, repair or disassemble the product. Do not use a damaged unit, frayed cable or damaged adapter. Keep small parts away from children. Supervise children around any electrical decoration.

Follow all local electrical codes and, if you rent, your landlord's rules and any HOA rules that apply to you. You're responsible for hanging the product safely and for any damage to your property caused by improper installation.

8. INTELLECTUAL PROPERTY

All content on this site — including text, graphics, logos, images, product photography, video, and the Pixel Terrace name and branding — is our property or used with permission, and is protected by copyright, trademark and other laws. You may not copy, reproduce, republish, sell or exploit any part of the site without our written permission.

9. YOUR SUBMISSIONS

If you send us reviews, comments, photos, videos, ideas or other content, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, publish and display that content in any medium, including in our marketing, without compensation to you.

You agree your submissions won't violate anyone's rights, won't contain unlawful, defamatory or obscene material, and won't contain malware. You're solely responsible for anything you submit. We're under no obligation to keep any submission confidential, to pay for it, or to respond to it, and we may remove content at any time for any reason.

10. THIRD-PARTY APPS, LINKS AND SERVICES

Our products are controlled by a third-party mobile app. That app is provided by its own developer under its own terms and privacy policy, and we're not responsible for the app, its availability, its updates, or how it handles your data. Please review the app's own terms before using it.

Our site may contain links to third-party sites or services we don't control. We're not responsible for their content, accuracy or practices, and linking to them doesn't mean we endorse them.

11. DISCLAIMER OF WARRANTIES

We do our best, but we can't promise the site will be uninterrupted, timely, secure or error-free, or that any results you get from using it will be accurate or reliable.

EXCEPT AS EXPRESSLY STATED IN THESE TERMS OR OUR RETURN & REFUND POLICY, THE SITE AND OUR PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Some states don't allow the exclusion of implied warranties, so some of the above may not apply to you. Nothing in these Terms limits any rights or remedies you have under applicable consumer protection law that can't be waived.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXEL TERRACE AND ITS OWNERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF USE, ARISING OUT OF YOUR USE OF THE SITE OR OUR PRODUCTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR ANY PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited under applicable law. Some states don't allow certain limitations, so some of the above may not apply to you.

13. INDEMNIFICATION

You agree to indemnify and hold harmless Pixel Terrace and its owners, employees and suppliers from any claim or demand, including reasonable attorneys' fees, made by any third party arising out of your breach of these Terms or your violation of any law or the rights of a third party.

14. CHANGES TO THESE TERMS

We may update these Terms at any time by posting a revised version on this page with a new "Last updated" date. Changes take effect when posted. Your continued use of the site after we post changes means you accept them. Please check this page from time to time.

15. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws rules.

If you have a problem, please email us first at dropifyy0@gmail.com — most issues get resolved quickly and informally, and we'd much rather fix it than fight about it.

Nothing in this section prevents you from bringing a claim in small claims court or from filing a complaint with a government consumer protection agency.

16. GENERAL

If any part of these Terms is found unenforceable, that part will be limited or removed to the minimum extent necessary, and the rest stays in effect.

These Terms and any policies posted on this site are the entire agreement between you and us regarding the site and your purchases, and replace any prior agreements. Our failure to enforce any part of these Terms isn't a waiver of our right to do so later.
